Amy advises on a variety of commercial and property disputes including contractual disputes, director and shareholder disputes, complex debt actions, dilapidations claims, 1954 Act process, breach of lease in both residential and commercial circumstances including service charge and ground rent disputes as well as title disputes.
Amy acts for both corporate and individual clients on pre-issue settlements, including those negotiated through mediation, as well as dealing with cases which are the subject of court proceedings.
Amy also has a background in the property management discipline with freeholder and leaseholders in more complex ground rent/service charge and rent charge disputes as well as acting in debt recovery/damages arising from contractual claims and issues concerning residential forfeiture including consents to be sought in leases.
- Successfully negotiating a contractual settlement in relation to a breach of contract claim involving a large portfolio of properties. Over 200% of the figure in Counsel’s advice achieved in a round table meeting against major insurer.
- Advising a freeholder on a mixed use development with social housing as head lessee. Negotiating the commercial settlement of offering head lessee to purchase the freehold by way of mediation.
- Reducing tenant dilapidations liability by £300,000 from negotiation and an extensive knowledge of s.18(1) Landlord and Tenant Act 1927.
- Acting on behalf of bicycle manufacturer against the EU Commission dismissing a complex anti-competitive import tax liability.
