Su specialises in both non-contentious and contentious restructuring matters, advising insolvency practitioners, banks, turnaround professionals, companies and directors on formal insolvency appointments, restructuring and security issues.
Su has experience of advising in connection with the turnaround, restructuring or insolvency of construction companies, care home operators, football clubs, hotel operators, private schools, property developers, retailers, solicitors and travel businesses.
- Acting for KPMG, the administrators of Countrywide Farmers Plc, in managing the sale process of 18 stores to 8 different buyers then subsequently working with the administrators to negotiate and deal with post-completion real estate and licensing issues.
- Assisting the board of directors, including a member of the Institute for Turnaround, in relation to a children’s equipment manufacturer including: providing directors’ duties advice; considering and advising on the options available to the business and its constituent parts; advising on the sale of the assets owned by a Romanian subsidiary; selling foreign jurisdiction intellectual property; and selling shares in a UAE subsidiary.
- Working as part of a team advising sureties who had provided bonds to a multinational construction company on a financial restructuring, including advising on: existing security; the effects of the changes proposed as part of the restructure; the availability of further security; and the documentation of that security.
- Working as part of the team acting for KPMG as administrators of Patisserie Valerie, leading the sale of the Baker & Spice division. This was one of 3 sales, all of which were conducted by a contract race over a 48-hour period to maximise realisations. Also assisting with real estate issues arising post-completion.
