Financial Disputes & Regulation

Unrivalled insight, expert advice and specialist recovery services

Our highly experienced team is adept at advising on all aspects of credit, leasing and financial compliance, regulation and litigation. We also offer unique understanding of FCA rules and specialise in title investigations and fraud recovery work.

When it comes to financial products and credit, Gateley Plc is able to offer unrivalled insight and expert end-to-end advice on everything from different credit agreements, regulatory compliance, FCA authorisations  to the successful recovery of money and/or assets if things go wrong. Unlike many other law firms, we’re able to handle both contentious and non-contentious work within a specialist single team.

We act for many different types of Banks, specialist lenders and leasing companies, who lend regulated and unregulated money to businesses and consumers.

Our extensive specialist consumer credit expertise is enhanced as a direct result of a senior team member being responsible for the start-to-finish drafting of aspects of the highly technical and complex Consumer Credit Act together with drafting, whilst on secondment to the FCA, its policy on the transposition of the Mortgage Credit Directive into the UK regulatory landscape. This gives us deep understanding of the thinking of the Financial Conduct Authority (FCA) and real insight into how to navigate the new and continually evolving regulatory landscape.

Our core business is acting for clients in the asset finance sector – where the products we focus on span hire purchase, conditional sale, operating lease, finance lease, stocking finance, pawn broking and bills of sale. We offer particular expertise in motor finance, truck finance, the leasing of yellow plant and agricultural machinery, and office equipment and telephony.

Alongside asset funding, we handle unsecured lending (typically store cards, credit cards, payment services, personal loans including high cost credit) and real estate secured lending (mortgages, second charges). We also act for clients in the secondary debt buyers’ market.

Whichever type of lending is chosen and whether credit is regulated or unregulated, we can provide drafting and regulatory advice to the highest order to put the agreement in place, and then monitor it to ensure compliance for the duration.

If the borrower defaults, we have an excellent reputation for litigating and recovering funds. Specialising in title investigations and fraud cases, we’re accomplished in multi-jurisdictional and cross-border asset recovery work – often dealing with elements of organised crime and terrorism. We’re not shy about devising unusual solutions to get effective results and successful outcomes.
