Kayleigh acts on behalf of local authorities, SME developers to national housebuilder clients , BTR investors, care home and retirement developers and education providers across the planning spectrum. Kayleigh has significant experience in supporting a wide range of clients in terms of site and corporate acquisitions (including planning due diligence and inputting into SPAs and collaboration agreements to secure appropriate Hillside protections) as well as in respect of specific planning requirements such as negotiating Section 106 Agreements, Deeds of Variation, highways agreements and providing advice in respect of tree preservation orders, Community Infrastructure Levy (“CIL”), enforcement, heritage issues, biodiversity net-gain, hillside issues and more recently CPO valuation.

Kayleigh has particular experience in planning enforcement and advising in respect of CIL. In terms of enforcement Kayleigh has provided advice in connection with a number of enforcement issues and supported a wide range of clients in respect of enforcement appeals and prosecution and advising on specific permitted development rights in the context of enforcement. Kayleigh has experience of providing strategic CIL advice including pre-scheme and in the context of CIL Reviews and Appeals.

Experience

  1. Advising a local planning authority in respect of a number of Section 106 Agreements for a wide range of schemes within its administrative area including large scale housing and mixed use development, including the authority’s first BNG Habitat Bank s106;
  2. Providing planning support for housebuilders and BTR investors on the acquisition of a number of complex schemes, including advising on Hillside risks (and drafting protections in the relevant acquisition documentation) and assisting with the general due diligence process;
  3. Extensive experience in drafting and negotiating s106 Agreements for housebuilders (both SME and national), education providers and care home developers. This includes advising on affordable housing, biodiversity net gain (both statutory and non-statutory), employment skills provisions, viability and other requirements;
  4. Advising local authority in respect of a CPO valuation reference including preparing witness statements, liaising and co-ordinating experts and Counsel and reviewing and advising on historic evidence in the context of the CPO rules;
  5. Advising clients (both private individuals, developers and landowners) generally in respect of planning matters, including enforcement (both in terms of risk and also in leading on enforcement appeals), permitted development rights, implementation of planning permissions, CLEUDS/CLOPUDs, TPOs and listed buildings and heritage issues.
