Contracts

contracts may not be generally be concluded on behalf of ourselves by email.  Where any client engagement with you is entered into via email, you may be able to bring a complaint about our services via the European Online Dispute Resolution platform which can be found at http://ec.europa.eu/odr.

Encryption

Please note that any e-mail sent to or from ourselves and any attachments will not be encrypted unless a secure e-mail service is utilised for communications with you. They may therefore be liable to be compromised. This is an inherent risk in relation to email.  We do not, to the extent permitted by law, accept any liability (whether in contract, negligence or otherwise) for any external compromise of security and/or confidentiality in relation to transmissions sent by email.

Forums, notice boards and chat rooms

Complaints

We are committed to providing a high-quality service to all of our clients. When something goes wrong, we need you to tell us about it. This will help us to improve our standards.

In the first instance, it may be helpful to contact the person dealing with your matter or your Relationship Manager to discuss your concerns. We will do our best to resolve the problem. If your complaint is not resolved to your satisfaction, or you do not have a Relationship Manager, then please send your complaint to our Executive Director & Partner, Michael Ward, at complaints@gateleyplc.com or Gateley Plc, One Eleven Edmund Street, Birmingham B3 2HJ or contact us on 0121 234 0000.

What will happen next?

  1. We will send you a letter confirming that we've received your complaint within three working days. We'll also send you a copy of this policy.
  2. We will then investigate your complaint.
  3. We will write to you within a further 10 working days with a view to resolving your complaint. We may invite you to a meeting to discuss and hopefully resolve your complaint. Within five working days of any meeting, we will write to you to confirm what we discussed and any solutions we agreed with you.
  4. You will then be asked to confirm whether there is anything else that needs to be considered or whether any additional clarification is required.
  5. We will write to you within 10 working days of receiving any further information or any request for further clarification confirming our final position on your complaint and explaining our reasons.

If we have to change any of the timescales above, we will let you know and explain why.

Gateley Legal, the Legal Ombudsman and the SRA

If your complaint relates to work by Gateley Legal, and you are not satisfied on written receipt of our final position, you may be able to complain to the Legal Ombudsman. The Legal Ombudsman will look at your complaint independently and it will not affect how we handle your matter.

Before accepting a complaint for investigation, the Legal Ombudsman will check that you have tried to resolve your complaint with us first. If you have, then you must take your complaint to the Legal Ombudsman:

  • within six months of receiving our final response to your complaint;

and

  • no more than six years from the date of act/omission; or
  • no more than three years from when you should reasonably have known there was cause for complaint.

RICS can help if you are concerned about our behaviour. This could be for things like dishonesty, taking or losing your money or treating you unfairly because of your age, a disability or other characteristic. Adamson Jones, Symbiosis IP and IPReg

If your complaint relates to work by Adamson Jones or Symbiosis IP and you are not satisfied after you have received written confirmation of our final position, you can refer your complaint to the Intellectual Property Regulation Board (IPReg), the regulatory body for registered patent attorneys and trade mark attorneys. IPReg deals with complaints in relation to breaches of the Rules of Conduct and Litigators’ Code of Conduct. Members of Gateley have the benefit of professional indemnity insurance as required by the appropriate regulator as detailed below. The policies cover appropriate territories.

Gateley Legal (Gateley Plc) maintains cover that is compliant with the minimum terms and conditions required by the Solicitors Regulation Authority of England and Wales in accordance with the Solicitors' Indemnity Insurance Rules 2013. Minimum mandatory cover is provided by Qualifying insurer, Aviva Insurance Limited.

Entrust Pension Limited maintains cover that is compliant with the minimum terms and conditions required by the Solicitors Regulation Authority of England and Wales in accordance with the Solicitors' Indemnity Insurance Rules 2013.
