Food safety & product recall

Gateley Legal

Food and product safety issues can eat into a business’ reputation – and their bottom line.

We move fast to help our clients navigate the decisions that need to be made when facing a food safety, product safety or recall issue. Our team recommend the best course of action to prevent or limit damage to reputation, protect brand and significantly reduce or remove the risk of enforcement or litigation.

What do we do?

We’re here to manage the risk of or fall-out from product safety problems before and after any issues arise. We review due diligence procedures and also provide the necessary support and advice should recall considerations be required. We’ve successfully handled numerous product safety related problems – spanning everything from consumer goods, such as soft furnishings, to contaminated and incorrectly labelled food.

Our experts advise on all areas of retail/ trading law, food safety and product safety law, including when and how to recall products from both the non-food and food sectors. We regularly advise manufacturers, suppliers and distributors on the law and regulatory framework and their obligations under product-specific legislation. We also advise on the health and safety obligations related to any equipment supplied for use at work.

The team handles matters at all stages including providing initial crisis management advice in addition to advising on investigations and at inquest and prosecution.
Legal 500 UK, 2018

We guide our clients through regulatory investigations and will always try to persuade the investigating authority not to prosecute. In the event that a prosecution does proceed, we support our clients through that process and represent their interests in court.

Who do we help?

Our experts advise manufacturers, retailers, suppliers and distributors of food and non-food products to the consumer and business markets in the UK and abroad.
