Welcome to the Gateley DEI compliance audit

Assess your organisation’s ability to prevent harassment and protect your workers via our comprehensive easy-to-use DEI audit.

This audit is designed to enable Gateley Legal to assess your organisation’s ability to:

  • comply with the new legal duty for employers to take reasonable steps to prevent sexual harassment;
  • prevent all other forms of harassment and victimisation at work; 
  • respond appropriately if any form of harassment or victimisation occurs; 
  • show that it has taken all reasonable steps to prevent harassment or victimisation (which can provide a “statutory defence” to tribunal claims); and
  • comply with applicable EHRC & Acas codes of practice and guidance in relation to tackling harassment and victimisation in the workplace.

There is no prescribed minimum regarding what an employer can do to prevent harassment and protect its workers; it is an objective test about what it is reasonable for the employer to do in the circumstances. This will vary depending on the size and nature of the employer, the resources available to it and the risk factors which need to be addressed within the organisation or sector. However, no employer is exempt from the legal duties because of their size.

The audit is broken down into 6 parts:

  1. About your organisation
  2. Your organisation’s culture
  3. Taking steps to prevent harassment
  4. Reporting mechanisms
  5. Responding to harassment 
  6. Document upload (for policies, procedures, contracts, training materials and other relevant documents)

You do not have to complete each section, but please provide as much information and documentation as possible. 

At the end of each section is a “free-text” question where if you wish you can provide additional information relevant to that question which will be considered by us in preparing our report. You can also save your progress at the end of each section, allowing you to come back to the audit and complete it at a later time. The audit is designed so that it should be possible to be completed in approximately two hours, although it may take longer than this depending on whether or not you have the relevant documents to be uploaded (e.g. training materials, policies etc).to hand or need to obtain these from within other functions of your organisation.

The completed audit and our report are confidential between Gateley Legal and your organisation. In addition, as the audit and our report are being prepared for the purposes of obtaining or giving legal advice or assistance, legal advice privilege will normally apply so that they are protected from disclosure in the event of litigation. If this audit has also been prepared in for the purpose of pending, reasonably contemplated or existing court or tribunal proceedings, litigation privilege may also apply.
