Every developer will need advice on commercial contracts, data protection and procurement at some stage. If the adviser doesn’t understand the nuances of the sector, it can leave the developer with advice that isn’t fit for purpose. We understand property and construction inside out and work with more developers than most of our competitors. This means we can combine sector knowledge with technical expertise to deliver the right advice to build-to-rent organisations.
Our team have extensive experience advising a wide range of clients, including developers, on their commercial agreements. This ranges from IT contracts, outsourcing agreements and joint ventures to housing management contracts, reactive repairs contracts and consultant framework appointments.
They also work with a range of property companies on data protection queries and freedom of information requests. Developers of all types often receive queries from property purchasers or renters, including Subject Access Requests, requests from past tenants asking for their data to be deleted, and third-party data sharing inquiries. Our team is set up to work with in-house legal teams and data protection officers, to handle queries on their behalf, either ad-hoc or a volume of requests.
The team work with developers who work with the public sector on all aspects of the public procurement process and are skilled at advising on tenders, including reviewing and reporting on tender documents and proposed contracts, assisting with the clarification stage, preparing board and risk analysis reports, as well as negotiating key issues in contracts and finalising the documentation after the award has been made.
Where a bidder doesn’t feel the process has been run fairly and the procurement rules haven’t been followed, our procurement disputes experts have experience helping developers to challenge decisions. We can also provide training on the Procurement Act 2023 to help ensure compliance with the new Act.
