Environmental, H&S and business defence for build-to-rent organisations

Build-to-rent developments face stringent environmental and health & safety regulations throughout construction and operation. Non-compliance can lead to enforcement action, financial penalties, reputational damage, and even criminal liability for directors and senior managers. Having the right legal support ensures your business is protected before issues arise – and defended effectively if they do.

Gateley offers specialist legal services to help BTR developers, operators, and investors manage compliance and defend their business.

  • Environmental law advice – Guidance on contaminated land, waste management, and water and air quality.
  • Health & safety legal support – Advice on CDM Regulations, site safety obligations, and operational compliance.
  • Business defence and regulatory investigations – Representation in criminal investigations, enforcement actions, and prosecutions by regulators such as the HSE or Environment Agency.
  • Crisis management and incident response – Immediate legal support to protect your position and mitigate reputational damage.
  • Governance and training – Helping boards and senior managers understand their legal responsibilities and implement robust compliance frameworks.

Our team combines deep regulatory knowledge with practical commercial insight, giving you a proactive and defensive legal strategy. We understand the unique challenges of BTR and provide solutions that keep your developments compliant, safe, and legally protected.

just some of our experience

  • Advising a leading construction company in connection with the HSE investigation and inquest following the death of a child who was trapped by electric gates on one of their developments. Avoided any adverse verdict at the inquest and prevented any further HSE investigation.

  • Appointed to advise a client in relation to its environmental obligations pursuant to the development agreement entered into some years ago to redevelop a former hospital.

  • Advising a client in relation to understanding the onsite and offsite environmental migration risks concerning the sale and redevelopment of contaminated land in the East Midlands. Contaminated through former industrial use, planning permission will be sought to deliver residential development.

  • Formerly a pharmaceutical factory, we were appointed to advise our client on the onsite and offsite environmental risks in line with proposed redevelopment of the site.
