With over 16 years in quantity surveying and commercial management in the construction industry, Mark boasts wide-ranging experience working for regional and national tier-1 contractors of differing size and operation, managing new-build, extensions, fit-out and refurbishment projects. Mark has worked in various sectors including healthcare, residential, aerospace engineering, custodial facilities, industrial, office, retail and banking; and across various JCT, NEC and bespoke forms of contract and sub-contract.
With an LLM in Construction Law and Practice (distinction) and a B.Sc. in Quantity Surveying, Mark currently provides:
- surety claims advice to contract guarantee bond providers,
- commercial and dispute resolution advice including adjudication support to parties to construction contracts, and
- quantity surveying and commercial management services to contractors and subcontractors.
Mark is also a trained Emergency First Aider and Mental Health First Aider.
How do you help clients?
I provide a range of claims advice, commercial support and quantity surveying services to our clients.
I support performance bond providers by establishing the extent of their liability in the event of a claim or potential claim, assessing various heads of claim in respect of principle and quantum, and assisting guarantors in working towards the resolution of a claim or negotiation of a settlement. By examining the facts surrounding a claim and the beneficiary’s entitlement to recover losses stemming from an insolvency or breach of contract, I can advise our clients of the risks, opportunities, and the best way to progress and conclude a claim.
I support parties to construction disputes by providing contractual and commercial advice to assist in both the defending and compiling of claims. My role may involve quantifying entitlement in respect of re-measure, changes/ variations/ compensation events, loss and expense, liquidated damages, general damages and set-off. I can then support our clients in decision making, negotiations, and even by commencing or defending against adjudication proceedings.
I also help contractors and subcontractors manage risk by providing contract review advice, both pre-contract and post-contract. Where our clients receive complex and/ or onerous contracts, my role can involve analysing and advising on the contract’s various processes, discussing these in the context of our individual clients’ abilities and requirements, and supporting negotiations towards a manageable agreement. Post-contract, I also provide advice and training on how to implement the contract, such as by identifying processes, timescales and condition precedents surrounding payment, variation claims, extension of time claims etc.
